A landlord has the right to make a dilapidation claim at any point during the lease, but it is most commonly done towards the end of the lease. The retail landlord is legally allowed to claim up to six years after the lease has ended, but the Dilapidations Protocol recommends that claims be made within 56 days of the lease ending. In some cases, a dilapidation claim may need to be made during the lease if there is a statutory lease renewal, a break clause, or if the property's disrepair is affecting its value.
