What are Retail Dilapidations

Retail Dilapidations refer to the costs a retail tenant is expected to bear at the end of a commercial lease. These costs are attributed to restoring the retail property to its original state, including repairing damages and reinstating cosmetic alterations. The landlord serves a 'schedule of dilapidations' to their retail tenant, which may be served during the lease if necessary. However, it is not uncommon for disputes to arise due to the unexpected nature of these costs.

When can a Claim for your Retail Dilapidations be made?

A landlord has the right to make a dilapidation claim at any point during the lease, but it is most commonly done towards the end of the lease. The retail landlord is legally allowed to claim up to six years after the lease has ended, but the Dilapidations Protocol recommends that claims be made within 56 days of the lease ending. In some cases, a dilapidation claim may need to be made during the lease if there is a statutory lease renewal, a break clause, or if the property's disrepair is affecting its value. 

What remedies can Retail Landlords seek during a dilapidation claim?

Retail Landlords have four potential remedies available to them for disrepair issues. The most suitable remedy will depend on the specific circumstances and repairs required. These remedies include: claiming monetary damages to compensate for the disrepair, seeking particular performance from the tenant to carry out the necessary repairs, terminating the lease through forfeiture if it has been breached (as stated in the lease agreement), and entering the premises to carry out repair work during the lease term (if allowed by the lease). Landlords should confidently choose the most appropriate remedy for their situation.
